2. What We Are …plus The Supreme Court

What we are and what we are not.
We’re an alternative advertising postal service that specializes in arranging to-the-home mass market deliveries.  We are not a solicitation company.  Work crews do not engage in conversation, sell, take polls, fish for leads or interact verbally with residents or neighbors.  What they do is hand deliver door hanger advertising and promotional material on behalf of local businesses to neighborhood households in the eastern half of American.

Crews should not need community permits or licenses to deliver your ad material.  Since we are not a solicitation company and do not engage in selling practices we are protected by First Amendment law the same way the US Postal Service is allowed to deliver their unsolicited mail.   The Martin vs. Struthers; United States Supreme Court ruling also guards our client’s right to offer unsolicited freedom of speech and to go door to door with their printed communications.  However, sometimes municipalities, over protective police departments, and zealous law directors disagree with the law of the land.  Many times the following letter helps clear things up.

WE ARE NOT A SOLICITATION COMPANY.  WE DO NOT ENGAGE IN CONVERSATION.
WE SIMPLY DELIVER DOOR HANGER ADVERTISING AND OTHER PROMOTIONAL MATERIAL ON BEHALF OF LOCAL BUSINESSES TO HOUSEHOLDS IN AMERICA.

WinAd Door To Door is an Ohio based company that works directly or sub-contracts indirectly to deliver door hanger advertising, promotional material, product samples, marketing material and political literature to people’s homes, apartments and businesses.  We strive to be courteous and professional and are a member in good standing with the national Door To Door delivery organization AAPS (the Association of Alternate Postal Systems).

Other than to say “Hello” if approached, our crews do not converse, sell, influence, attempt to solicit, ring doorbells, knock on doors, ask for money or engage in any conversational behavior whatsoever with community members.  These are all firing offenses that lead to immediate dismissal.  Infield supervisors and carriers are instructed to never do these things.  They simply deliver commercial and non-commercial print material and product samples on behalf of local businesses to households in various states and communities.  We try to be as efficient as possible and remain in an area only as long as it takes to complete our work.

We respect the law and a community’s right to enforce their local ordinances.  However, distribution of printed information on a Door To Door basis is protected under the First Amendment and as such should not be regulated or restricted by local governments through licensing or permitting.  Since we are not soliciting we should not need a permit to do our work.  In this regard we are no different than the US Post Office, or religious, political, and non-profit groups that pass out pamphlets.  For clarification please do a quick Wikipedia internet search for Martin vs. Struthers; United States Supreme Court ruling.

We are a responsible company and operate in a professional lawful manner and instruct our carriers to never place material inside post boxes.   If you should have further questions please contact WinAd Door To Door at: 440-665-2267 or 216-288-2067.
